1. Acceptance of Terms
By accessing or using StokeBot ("the Service"), including the web application and mobile applications for iOS and Android, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not use the Service.
2. Program Description
Program name: StokeBot
StokeBot is a real-time mountain intelligence platform that delivers snow condition reports, parking status updates, weather forecasts, AI-powered chat assistance, and customizable notifications for mountain enthusiasts. The Service is available via web application, mobile app (iOS and Android), email, WhatsApp messaging, and push notifications.
When you opt in to notifications, you will receive automated messages via your chosen channels including daily snow reports, daily digests, parking alerts, stoke alerts (powder day notifications), broadcast announcements, and AI chat responses.
Message frequency: Message frequency varies based on your subscription settings and mountain conditions. You may receive up to several messages per day depending on your configured notification flows and any conversations you initiate with the AI chat assistant.
Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
3. User Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You may not share your account with others or create multiple accounts
- We reserve the right to suspend or terminate accounts that violate these terms
Account Deletion
You may delete your account at any time via Settings > Delete Account in the mobile app or by contacting [email protected]. Account deletion triggers a 30-day grace period during which your data is anonymized. After this period, your personal information is permanently removed from our active systems, though some data may be retained for legal, security, or operational purposes as required by law.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use automated systems (bots, scrapers) to access the Service without permission
- Abuse the AI chat feature by submitting harmful, abusive, or excessively repetitive content
- Resell or redistribute data obtained from the Service
5. AI Chat Feature & Usage Limits
The AI chat assistant is provided for informational purposes only. Responses are generated by artificial intelligence and may not always be accurate or up to date.
- AI responses about weather, snow conditions, and local information should not be relied upon as the sole basis for safety-critical decisions
- Always check official resort communications and avalanche forecasts before heading into the backcountry or making travel decisions
- We do not guarantee the accuracy, completeness, or timeliness of AI-generated content
- Free tier users are limited to 20 AI chat messages per day, resetting at midnight (local time). This limit helps us manage service costs and ensure fair access for all users.
6. Mountain Condition Data
Snow reports, parking status, and weather data are sourced from third-party providers and resort websites. This data is provided "as is" and may be delayed, incomplete, or inaccurate. StokeBot is not responsible for decisions made based on this data.
7. Messaging & Communications
Consent to Receive Messages
By subscribing to notifications and verifying your delivery channels, you expressly consent to receiving automated messages from StokeBot via email, WhatsApp, mobile push notifications, and any other channels you enable. These messages may include snow condition reports, parking alerts, stoke alerts, daily digests, broadcast messages, and AI chat responses.
Inbound Messages
When you send messages to StokeBot via WhatsApp, the mobile app chat, or other messaging platforms, those messages are processed by our AI system to generate responses. By sending messages to StokeBot, you consent to this processing. Do not send sensitive personal information (financial data, medical records, passwords) via chat.
Outbound Messages
StokeBot sends automated messages based on your subscription settings, including scheduled notifications and event-triggered alerts. Message frequency depends on your subscription configuration and mountain conditions.

Opting Out
Text STOP to the StokeBot WhatsApp number at any time to opt out of all WhatsApp messages. You will receive a confirmation message and no further messages will be sent to your number. You may also opt out by updating your settings in the web dashboard or mobile app Settings screen. Mobile push notifications can be disabled via your device's notification settings or the app's Settings screen. Opting out of notifications does not delete your account.
Email Communications
Transactional emails (account verification, password resets) are sent regardless of notification preferences. You may unsubscribe from notification emails via your dashboard settings or by contacting [email protected].
Rates
Message and data rates may apply. StokeBot does not charge for messages, but your wireless carrier's standard messaging and data rates apply.
8. Intellectual Property
The Service, including its design, code, features, and content, is owned by StokeBot and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
9. Limitation of Liability
To the fullest extent permitted by law, StokeBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages for loss of profits, data, or other intangible losses.
StokeBot is not liable for any injuries, accidents, or damages resulting from decisions made based on information provided by the Service, including AI-generated content, weather data, or snow condition reports.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time without notice.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
